Break Lease Notice to Vacate Form

Sometimes things happen and a renter needs to move out of a property before their current lease has expired i.e., got a job overseas or interstate, going through a significant life change, has serious health issues etc. This is known as a ‘Lease Break.’ In accordance with the Residential Tenancies Act and your lease agreement special conditions, you are required to 

  • Give us written notice of your intention to break your lease (see form below) 
  • Pay rent up until the lease ends or until the new renter’s lease commences (whichever comes first), even if you have physically vacated the property prior to that date. 
  • Pay a break lease fee, your property manager will notify you of these costs. You will be invoiced for this amount and must pay the invoice amount immediately. 
  • Notify us of a date you will be vacating the property so we can prepare it ready for re-leasing

If you know someone who wishes to lease the property, they are required to complete the application process as normal. You can discuss this with your property manager in more detail, however it is important that you understand there is no guarantee that this application will be approved

If you are currently not in a fixed term agreement and wish to vacate, please complete the 28 Days’ Notice to Vacate Form.


  • 1. In accordance with the Residential Tenancies Act (1997) I/We hereby give notice to vacate the above premises.

    2. I understand that I am breaking my lease and am responsible for rent payments up until the lease ends or until the new tenant's lease commences (whichever comes first), even if I have physically vacated the property prior to that date.

    3. I understand that I am responsible for payment of a break lease fee. I will be invoiced for this amount and must pay the invoice amount immediately.


  • I/We give consent to the Agent on behalf of the Rental Provider (Landlord) to have the property shown to prospective tenants prior to my/our vacation. This includes both private inspections and open house inspections.

    5. I/We understand and agree that notification for upcoming inspections (both private and open house) will come to us in the form of an SMS message on the above mobile number. This is the form of notice that Reliance Real Estate provides, if you do not agree you must provide an alternative form of communication when handing in this form.

    6. I/We understand and agree that if the agent attends the property for a pre-arranged inspection and we are not home they will use the spare keys to enter the premises and conduct the inspection.
